On Wednesday February 10, 2021, Member Liam L. Murphy made a presentation at the Vermont Bar Association Real Estate Law Day miniseries entitled: “Properties which are Non-Conforming or Non-Complying or Subject to Unenforceable Violations (and MORE!)”
He discussed marketability of legally pre-existing non-conformities versus properties with unenforceable violations as a result of the 15 year “Bianchi” statue of limitations. In addition he discussed the recently enacted 27 VSA 545 and its effects on agreements and covenants limiting development on Vermont properties and the proposed legislative revisions to the new act.
