MSK’s real estate attorney team has extensive experience representing clients in connection with development projects throughout Vermont; including commercial, industrial, retail, hotel, resort and recreational, office, residential and mixed-use projects. We are skilled in the acquisition, design, permitting, construction and development processes. Our services also include assistance with financing, leasing and project management. MSK also advises clients with respect to brownfields and infill development.
Residential and Commercial Real Estate Transactions
MSK represents clients throughout Vermont in the purchase and sale of all types of residential and commercial real estate, including office buildings, shopping centers, residential properties, hotels and resorts, pharmacies, industrial sites, warehouses, manufacturing facilities and other commercial properties. MSK also advises clients with respect to the purchase and development of infill lots and environmentally contaminated or sensitive properties such as brownfields. MSK has represented a number of clients in complex cross-border transactions with Canadian and other foreign investors. Some of these transactions were structured as traditional purchase and sale transactions and others as more complex arrangements, including new entity structures, “1031” like-kind exchanges and other deferred tax mechanisms.
Leasing
MSK represents owners and tenants in drafting and negotiating leases and subleases, including long term ground leases, build-to-suit agreements and financing leases. We have handled leases for offices, retail stores, shopping centers, industrial facilities, warehouses, manufacturing facilities, restaurants, telecommunications facilities, and solar arrays. These transactions often include financing arrangements, transfer tax issues and property tax issues.
Condominium Law
MSK represents numerous condominium and homeowner associations with respect to governance issues, amendment of association documents, permit and statutory compliance issues, property tax appeals, foreclosure and collection proceedings, and litigation against developers and contractors.
