MSK’s attorneys have assisted national telecommunications service providers to establish their Vermont communications networks, providing strategic input with respect to project design; assisting with the acquisition of project sites through purchases, ground leases and tower leases; and assisting with every phase of the municipal and state permitting processes throughout Vermont.
Founding Partner Brian Sullivan, an amateur radio enthusiast, also represents “ham” operators in their efforts to construct towers pursuant to the FCC’s PRB-1 ruling.
MSK coordinates interdisciplinary teams to prepare permit applications and appear before municipal development review boards, Act 250 Commissions, and the Vermont Public Utility Commission. Our Public Utility Commission practice includes both telecommunications, under Section 248a, and other types of utility work under Section 248. We also assist in determining project compliance with the requirements of the National Environmental Policy Act and the National Historic Preservation Act. If necessary, we represent clients in appeals from municipal and state decisions to Vermont’s state and federal courts.
