Attorneys Murphy, LaRosa and Ellermann presented at the Vermont Bar Association’s May 24, 2016 event, “Spring Cleaning Environmental Style.” The continuing legal education meeting in Montpelier brought together Judge Durkin, Judge Walsh, and the Court staff of the Vermont Superior Court’s Environmental Division, along with attorneys in public and private practice across the state, to discuss Environmental Division updates, emerging environmental and land use law issues, and effective Vermont land use law practice. Attorney LaRosa presented on the effect of Act 64, also known as Vermont’s Clean Water Act, on existing developed land and required stormwater retrofitting. Attorney Murphy discussed the land title implications of these stormwater regulations and explored the obligations of title examiners in identifying risks of noncompliance with these regulations. Attorney Ellermann and her former co-clerk at the Environmental Division, Attorney Ryan Kane, led a conversation about drafting an effective Statement of Questions in the Environmental Division, as well as some of the common challenges in preparing this important pleading, which establishes the scope of an appeal in the environmental court.
