The Vermont Supreme Court heard oral argument on a dispute over a landowner’s right to improve roads to develop property. In Rhodes v. Town of Georgia, the trial court found that the Town had violated previous court orders relating to road improvements and that the Town’s actions had violated the “common benefits” clause of the Vermont Constitution because it favored the landowner’s neighbor. The trial court awarded $830,000 in damages to the landowner because the Town deprived him the ability to develop a portion of his property.
